Welcome to PC Janse Art ("we," "our," or "the store"). By accessing or using this website, you agree to comply with and be bound by the following terms and conditions. If you do not agree with any of these terms, you must refrain from using the site. These Terms of Service are governed by the laws of South Africa, specifically the Consumer Protection Act (CPA), Electronic Communications and Transactions Act (ECTA), and other applicable regulations.

2. Products and Pricing

All prices listed on the website are in South African Rand (ZAR) and include VAT (where applicable). Prices and availability of products may change without notice.

  • Custom Commissions: Prices for commissioned artworks will be quoted individually and may vary based on size, medium, and complexity.
  • Shipping Costs: Shipping costs are calculated separately and will be displayed at checkout.

3. Payment Terms

We accept various payment methods, including bank transfers, credit/debit cards, and third-party payment gateways. All payments are processed securely. By purchasing, you agree to the processing of payments as per the terms of the selected payment method.

Non-refundable Deposit for Commissions: A 50% non-refundable deposit is required for all commissioned artworks, with the balance payable upon delivery or collection.

4. Order Process

Once an order is placed, you will receive a confirmation email. We reserve the right to refuse or cancel an order for any reason, including inaccuracies in product listings, pricing errors, or lack of stock availability.

5. Shipping Policy

Orders are shipped via third-party courier services within South Africa. Shipping timeframes may vary depending on the location and service selected. While we aim to deliver within the specified time, delays beyond our control may occur.

6. Return and Refund Policy

We provide a 7-day return policy for damaged or defective products. The following conditions apply:

  • Damaged Products: If your artwork or product is damaged upon delivery, you must notify us within 7 days, providing photographic evidence.
  • Change of Mind: Returns due to change of mind are accepted within 7 days of delivery, provided the artwork is in its original condition. Return shipping costs are the buyer's responsibility.

Please note: Commissions and personalized artworks are not eligible for returns, as these are custom-made to order.

7. Intellectual Property

All content, including artwork, images, and text on this website, is the intellectual property of PC Janse Art and may not be reproduced, copied, or distributed without express permission. Unauthorized use of any content may result in legal action.

8. Privacy Policy

Your personal information is handled with the utmost care and in compliance with POPIA (Protection of Personal Information Act). We will not share your details with any third parties except for processing orders (e.g., payment gateways or couriers).

9. Limitation of Liability

PC Janse Art is not liable for any damages arising from the use or inability to use this website or products, including indirect or consequential damages. By purchasing, you accept all responsibility for the appropriate use of the products.

10. Governing Law

These Terms of Service are governed by the laws of South Africa, and any disputes will be resolved within the South African legal system.

We reserve the right to update or modify these Terms of Service at any time. Changes will be effective upon posting to the website, and continued use of the site indicates your acceptance of the revised terms.
